Rather, the Coach is a mentor and guide who has been trained in techniques to help clients reach their goals. The Client understands that the Coach is not acting in the capacity of a doctor, licensed dietician, psychologist or other licensed or registered professional, and that any advice given by the Coach is not meant to take the place of advice by these professionals. If the Client is under the care of a health care professional or currently uses prescription medications, the Client should discuss any dietary changes or potential dietary supplements use with his or her doctor, and should not discontinue any prescription medications without first consulting his or her doctor.<\/span><\/p><p class=\"font_8 wixui-rich-text__text\"><span class=\"wixui-rich-text__text\">The Client has chosen to work with the Coach and understands that the information received should not be seen as medical or nursing advice and is not meant to take the place of seeing licensed health professionals.<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f1bc07c elementor-widget elementor-widget-heading\" data-id=\"f1bc07c\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">PERSONAL RESPONSIBILITY AND RELEASE OF HEALTH CARE RELATED CLAIMS<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-09b75a8 elementor-widget__width-inherit elementor-widget-mobile__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"09b75a8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p class=\"font_8 wixui-rich-text__text\"><span class=\"wixui-rich-text__text\">The Client acknowledges that the Client takes full responsibility for his or her life and well-being, as well as the lives and well-being of the Client\u2019s family and children (where applicable), and all decisions made during and after this program.\u00a0<\/span><\/p><p class=\"font_8 wixui-rich-text__text\"><span class=\"wixui-rich-text__text\"><span class=\"wixGuard wixui-rich-text__text\">\u200b<\/span><\/span><span class=\"wixui-rich-text__text\">The Client expressly assumes the risks of the Program, including the risks of changing their diet or supplements, and the risks inherent in making lifestyle changes and personal decisions. The Client releases the Coach from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which the Client ever had, now has or will have in the future against the Coach, arising from the Client\u2019s past or future participation in, or otherwise with respect to, the Coaching Contract, unless arising from the gross negligence of the Coach.<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5c0a6b5 elementor-widget elementor-widget-heading\" data-id=\"5c0a6b5\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">CONFIDENTIALITY<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-55375f9 elementor-widget__width-inherit elementor-widget-mobile__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"55375f9\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\tThe Coach will keep the Client\u2019s information private, and will not share the Client\u2019s information to any third party unless compelled to by law. Participation in any group coaching program means that the Client agrees to keep any and all information shared within the group sessions confidential.\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-346393f elementor-widget elementor-widget-heading\" data-id=\"346393f\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">ARBITRATION, CHOICE OF LAW, AND LIMITED REMEDIES<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-220f8d5 elementor-widget__width-inherit elementor-widget-mobile__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"220f8d5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p class=\"font_8 wixui-rich-text__text\"><span class=\"wixui-rich-text__text\">In the event that there ever arises a dispute between Coach and Client with respect to the services provided pursuant to this agreement or otherwise pertaining to the relationship between the parties, the parties agree to submit to binding arbitration before the American Arbitration Association (Commercial Arbitration and Mediation Center for the Americas Mediation and Arbitration Rules). Any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Such arbitration shall be conducted by a single arbitrator. The sole remedy that can be awarded to the Client in the event that an award is granted in arbitration is refund of the Program Fee. Without limiting the generality of the foregoing, no award of consequential or other damages, unless specifically set forth herein, may be granted to the Client.<\/span><\/p><p class=\"font_8 wixui-rich-text__text\"><span class=\"wixui-rich-text__text\"><span class=\"wixGuard wixui-rich-text__text\">\u200b<\/span><\/span><span class=\"wixui-rich-text__text\">This agreement shall be construed according to the laws of the State of Arizona. In the event that any provision of this Agreement is deemed unenforceable, the remaining portions of the Agreement shall be severed and remain in full force.<\/span><\/p><p class=\"font_8 wixui-rich-text__text\"><span class=\"wixui-rich-text__text\"><span class=\"wixGuard wixui-rich-text__text\">\u200b<\/span><\/span><span class=\"wixui-rich-text__text\">The Client acknowledges that: (1) he\/she has received a copy of these terms; (2) he\/she has had an opportunity to discuss the contents with the Coach and, if desired, to have it reviewed by an attorney; and (3) the client understands, accepts and agrees to abide by the terms hereof.<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3b9ff04 elementor-widget elementor-widget-heading\" data-id=\"3b9ff04\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">REFUND POLICY:<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7704610 elementor-widget__width-inherit elementor-widget-mobile__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"7704610\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p class=\"font_8 wixui-rich-text__text\"><span class=\"wixui-rich-text__text\">The Company provides a money-back guarantee for the Program with no time restrictions. As long as the Company is an active legal entity, refunds are available. That money-back guarantee is governed by the following terms:<\/span><\/p><p class=\"font_8 wixui-rich-text__text\"><span class=\"wixui-rich-text__text\">If upon completion of a private or group coaching program a client would like to receive a refund, the Client shall email\u00a0<a class=\"wixui-rich-text__text\" href=\"mailto:merianne@meriannedrew.com\" data-auto-recognition=\"true\">merianne@meriannedrew.com<\/a>\u00a0a petition including evidence of full participation in either Client-selected group Program or evidence that the Client followed the guidance and recommendations of the Coach in a Client-selected 1-on-1 coaching program. Within 48 hours of receipt of said petition, the Coach will perform a 24-hour review and if convinced beyond a reasonable doubt that services received did not match the value of monies paid, a full refund will be issued within 3 business days of review completion. If paused, client must reactivate selected coaching program within 3 months of pause to retain program rate. At time of pause, client is only fiscally responsible for sessions redeemed plus the cost of the toolkit ($80).
